Former Circuit Court Judge David Kimberley has joined Cusimano, Roberts & Mills, a Gadsden-based law firm known for its personal injury and consumer litigation work in Alabama and across the country.
Prior to winning his seat on the bench in 2006, Kimberley practiced law for more than 20 years with the Cusimano firm.

Along with representing clients, Judge Kimberley will be available for private judging. The term “private judging” refers to the process recognized across the country and by the Alabama State Bar that allows parties in a dispute to hire a qualified former judge to hear their case and make relevant decisions. Private judging allows the case to bypass the court system and streamlines the process for the parties.
While serving as circuit court judge, Kimberley resolved more than 14,000 cases, including three capital murder trials. During his tenure, he was appointed to the faculty of the National Judicial College, where he developed coursework for new judicial appointees.
Prior to serving as judge, Kimberley practiced litigation in numerous state and federal courts in Alabama. He appeared as attorney of record in both state and federal courts in Georgia, Arizona, Missouri and New Jersey. Kimberley has served on the Alabama Trial Lawyers Associations’ board of governors and executive committee.
Kimberley served as a member of the United States Naval Reserves in the 24th Naval Mobile Construction Battalion. He attended the Naval Justice School, was a battalion legal officer, and received a Naval Achievement Medal in 2000.
Kimberley is a graduate of the University of Alabama School of Law, University of Alabama College of Commerce and Business Administration, and Emma Sansom High School. He and his wife, Cindy, have two children, Kaitlyn, 28 and Andrew, 22.
